Regarding advertisements that use images of celebrities without permission (infringement of publicity rights)
……
REGAL CORE Co., Ltd. (Shibuya-ku, Tokyo, President and CEO: Hayato Tanoue), which handles the Pharmaceutical and Medical Device Act check business, has been publishing articles (LPs) (landing pages) that include expressions that may violate laws such as the Pharmaceutical and Medical Device Act and the Public Display Act. ) has been conducting regular surveys on the ad delivery status. Even after we pointed this out in a past release, we continue to confirm that many advertisements are being distributed that violate publicity rights (portrait rights) by using images of celebrities without permission. We would like to report on this issue, including a call to attention and our company’s future policy.
◆About the ads that are considered problematic
Until now, our company has been conducting periodic surveys mainly targeting advertisements distributed on web media, and during these surveys, we have pointed out expressions that could violate laws such as the Pharmaceutical and Medical Device Act and the Visual
Representation Act, and urged corrections. I’m here. As a result, while expressions that violate the Pharmaceutical and Medical Device Act are gradually decreasing, it has been confirmed that
advertisements for information products such as “I will teach you how to make money by investing” are being distributed in increasing numbers. I’m here.
In addition to the increasing number of advertisements in which images of celebrities are used or appear to be used without permission, the issue of advertisements leading to investment fraud has also come to light. .
As examples of actual distribution confirmed in previous
investigations, images and biographies of celebrities such as Takuro Morinaga, Hiroto Kiritani, and Takafumi Horie were used to make it appear as if the individuals themselves were involved in investment. There was an advertisement that said it would give out information and urged people to register for LINE, which they claim is theirs. As reported in a previous release by our company, there have been calls from celebrities whose images and biographies have been used without permission, as well as messages to alert people to the use of their images and biographies without permission. That is clear. Furthermore, it has been pointed out that these advertisements actually lead to investment fraud. (Reference: Takuro Morinaga’s column https://maga9.jp/231227-2/)
◆Details of confirmed articles
Advertisements that seem to give information on blue-chip stocks include things like “Add ●● (celebrity)’s LINE for free”, “You can join for free by adding ●● (celebrity)’s LINE”, and “●
●(Celebrities) communicate in the community and share investment skills and trading methods that have made money in the stock market for many years,” and “●●(Celebrities) Investment Club is currently free to join.” , we have confirmed that there are promotional expressions that use images without permission to induce users to register on LINE.
◆Future policy
Our company does not accept any promotional expressions that may be detrimental to consumers, such as infringing rights and stimulating purchasing intent by misleading customers into thinking that the product is being supervised and operated by a celebrity, as in this case. We believe that this is a problem that needs to be corrected as we strive to improve the health of the advertising industry. In addition, regarding survey results and advertisements that may mislead consumers or are considered to cause harm to consumers, we will report them to advertising industry organizations, the Consumer Affairs Agency, etc., and comply with the Pharmaceuticals and Medical Devices Act and the Visual Representation Act. We are calling on media companies to stop distributing not only advertisements that contain violating expressions, but also advertisements that have been pointed out to violate publicity rights or lead to investment fraud, as in this case. I shall go.
We will continue to take strict action against advertisements that are considered to be in violation of laws and regulations, and will continue to take a wide range of measures, focusing not only on the Pharmaceutical and Medical Device Act but also on rights infringements such as unauthorized use of images. We will conduct investigations from time to time to protect the interests of consumers.
