As the times and environment change, the entertainment industry is changing rapidly every day, from the way we think about production, to the production itself, to the methods of providing it, to the way viewers view it, how they feel, and how they work. In the
ever-changing entertainment industry, there may not be many people who know and understand the latest information on laws and rights. C&R welcomes Mr. Takashi Shinomiya, a lawyer and producer who is himself active in the entertainment industry, as a lecturer, and is holding a seminar series on laws that creators should know.
In this fourth installment, we will focus on case law regarding television programs. Television programs have a large audience of people of all ages and genders, so if issues such as copyright infringement, defamation, or unfair labor come up even once, it often becomes a major social problem. In some cases, the image of the TV station that aired the broadcast may be tarnished, production may be halted, actors may be forced to leave the show, or compensation may be paid. This time, we will take a look at cases involving lawsuits over suspected copyright infringement of TV dramas, as well as lawsuits that resulted in production being halted. Let’s deepen our
understanding of copyright by reading specific past court precedents to understand what was at issue in court cases and what kind of decisions were reached.
